As of November 5, 2009, Both houses of Congress have passed the bill that includes an ammendment to extend and expand the homebuyer tax credit. After a landslide vote of 98-0 the bill was sent to President Obama for his signature to sign into law Friday November 6, 2009. With the President's signature, the expiration date of the credit will move to April 30, 2010. First-time home buyers who have not had interest in a principle residence for 3 years are still eligible, and the amount of the tax credit remains the same of up to 10% of the purchase price with a maximum of $8,000. Single home buyers may apply for the full tax credit of $8,000. Married couples who file jointly may apply for the full tax credit of $8,000 (Please note that when married only 1 tax credit of $8,000 may apply). Married couples that file individually may apply for 1/2 of the tax credit of $4,000 each totaling $8,000 ($4,000 + $4,000 = $8,000) which is the full tax credit. Current homeowners/repeat buyers who have consecutively maintained the home they want to sell as their primary residence for 5 of the last 8 years, are also eligible. The tax credit structure is the same HOWEVER the maximum tax credit for those homeowners/repeat buyers is $6,500 for married couples who file jointly and $3,250 for those homeowners/repeat buyers who file individually. ($3,250 + $3,250 = $6,500) This only applies to to houses purchased after the current tax credit expires on November 30, 2009. The new bill would give buyers/repeat buyers until April 30, 2010 to sign purchase contracts and another 60 days to close. Income limits will be more generous: $125,000 a year for individuals, $225,000 a year for married couples. The tax credit may not be used to purchase a home for more than $800,000. All buyers who want to get the credit must include documentation of the purchase on their tax returns. This is a major victory for consumers, Realtors, and the housing market in general.
